I really can't believe the reaction I'm seeing here... More than a dozen companies engage in conspiracy and massive consumer fraud over the course of 16 years, get charged in federal court under racketeering and anti-trust laws, and no one wants to see them punished?

Just slap correct labels on and forget about it?

They sell an average of 6,000,000 mowers per year these companies, this isn't penny ante shit here.

Ah well, if that's the way you folks feel about it then that's how you feel about it. :dunno:

But just for my own information, where would you all "draw the line" and actually want to see some penalties handed out?

If McDonald's relabeled all their cups, so that the 12oz cups now claimed to be 20oz, and you were charged the 20oz price, would you care?

If you bought a battery for your truck and it was only 8 volts instead of 12, would you complain?

If you bought gas, but each "gallon" was only 100 ounces, what then?

Not really. I think the companies involved should serve some sort of punishment... I don't disagree that point at all. I just don't see much point in a class action suit.

If this is that big of a deal, then why hasn't anyone sued car companies for lying on the MPG ratings on new vehicles??? Lying about how much fuel a car/truck uses cost people way more then the HP of yard equipment. :dunno:

My dad had a '94 Toro Wheelhorse for the longest time, finally scrapped in 2006 :lol:. Ah lawyer schemes.

If this is that big of a deal, then why hasn't anyone sued car companies for lying on the MPG ratings on new vehicles??? Lying about how much fuel a car/truck uses cost people way more then the HP of yard equipment. :dunno:

Because the MPG ratings don't come from the manufacturers, they are set by the EPA

My dad had a '94 Toro Wheelhorse for the longest time, finally scrapped in 2006 :lol:. Ah lawyer schemes.

Too bad... as part of the settlement Toro is giving a one year extended warranty, which goes into effect after the settlement is finalized, probably in August. Could have gotten a new motor put in under warranty.

Who the hell cares if your 21" self-propelled mower has 6.75HP or 4HP?

THIS sort of litigious garbage makes me sick.

My Troy Bilt with a B&S engine claims it is 6.75 hp. Are you telling me it's only 4 hp? Well, for shame for shame. :(

Troy Built are made by a company called MTD, and they are the only ones in the settlement not paying any kind of penalty. Mostly, it seems, because when the shit hit the fan and the feds got involved they rolled over and squealed like a stuck pig. The corporate version of turning states evidence I think.

And yeah, in the court documents I read they tested the B&S 6.75, and the difference between what the actual horsepower was, and what the label claimed was considerable. From what I remember reading, the actual HP was something like 3.6, and they inflated that to 6.75, which is an 88% increase.

Damn. Not that I can feel any difference in a push mower, but I agree it is bullshit.
