It doesn't matter the condition really (unless it was obviously beat to hell). Say the truck is worth 7500 with those miles, then they should pay her 7500 because thats what it would cost her to replace it with a similar condition and mileage truck. Now if there is obvious previous damage elsewhere on teh truck, they may take that into account and lower the value. But if there is nothing wrong, they have to give at the very least low retail value. (OR "should") :dunno:

Thats why you need a lawyer. first of all, she has no insurance to even pay for the damage, or pay for the truck. So you will have to find a lawyer that is willing to take the case and sue the person who hit you. Good luck, because most lawyers know if they don't have insurance that you likely wont get a dime, even if a judge rules in your favor. If they can't afford an insurance payment each month, what makes you think they can addord to pay a $7500 court judgement? Lawyers know this and dont wanna waste their time. So good luck with this shit.

No shit... :jester: To figure out if its totaled You take the value of the truck in perfect condition with consideration of mileage ($7,700) and if the repair cost is more than 3/4 the value before it was wrecked ($7,700) then it's totaled. My dads truck before it was wrecked in perfect condition sells for around $6500-$7500 in my area.

It's my understanding that in most places the value of the vehicle is considered based on the condition just prior to the accident. I'll wait for Jim to chime in but I doubt perfect condition is the default, especially considering the fact most cars are never in perfect condition.


Most insurance companies will give anywhere between Average Trade and Clean trade.

Being that Clean retail for this truck is only $7300 and that would mean that it was perfectly mint needing absolutely nothing prior to to the accident.

My guess if there was insurance on this truck by the person that his it or full coverage enough money would be offered to cover the repairs.

$4-5k

Also, not all the time will they total a vehicle if the damage is 75% of the value. In 2003, my Father-in-Law's 99 Silverado was rear ended. I think they said it was worth at least 16k at that time. It had almost 12k worth of damage and they repaired it. I know the frame was bent (not sure if it was straigtened or replaced) and he needed at whole new bed, and there was damage on the cab where the bed was pushed into the cab. I remember after he got it out of the body shop, the rear end pinion bearings went out like a week or so later, and he made them replace that too.

I had a knock around truck in Arkansas a 93 for Ranger 2 wd XLT I hit deer with. The insurance totaled it. This was about 5 years ago. I got $2200 and the truck from the insurance company...Metlife. Truck was not pretty had almost 300,000 miles but was never wrecked prior, small dings and the top of the tail gate was dented down. It had fWONked up factory black paint but had never been painted. It ran and drove great even after hitting the deer.

I spent about $400 on parts at the local junk yard from a truck the same color and put it back together. I sold it about a year later and they never did report it as scrap title...LOL!!! I sold the truck for $2000.00.....I only paid $800.00 for it.

I think value is all up to the appraiser and I know Metlife did a local market value study, they actually pulled advertisements from local dealers and private party sellers to determine the trucks value. I had to laugh when i saw what they came up with......but I did not argue!!

If you have just the minimum Liability Insurance and no Collision coverage, the insurance company does not pay to fix YOUR vehicle. They will pay the other person to have their shit fixed but you are on your own fixing your stuff.

So if you have only Liability they could care less what condition your vehicle is in because they aren't gonna fix it regardless.

Sorry to hear that man. How close to the $7700 is the estimate? My mom had her car hit (it's been 20 years ago now) and they wanted to total it. My parents had them put some used doors on it, and that brought it under the cap.

No uninsured motorist coverage + uninsured motorist + liability only = jack shit paid by anyone.
